Notice is hereby given that a public hearing will
be held on Thursday, February 26, 2004
at 9:00 a.m. in the County Board Room of the Bayfield County Courthouse,
Washburn Wisconsin relative to the following item(s):
Susan Keachie is seeking a variance
from the terms of Section 13-1-60(a) and 14-1-80(a) of the Bayfield County
Zoning Ordinance. Section 13-1-60(a) requires buildings and structures to
be setback a minimum of 5’ from side and rear yard property lines.
Applicant seeks to convey land to an adjoiner, therefore; reducing the
side yard setback to zero (0) from the newly created property boundary.
Section 14-1-80(a) of the Bayfield County Zoning Ordinance requires/states
lot size shall conform with the area and width dimensional requirements
outlined in Section 13-1-60 of the Bayfield County Zoning Code. In those
townships, which have not ratified the Bayfield County Zoning Code, the
minimum lot size standards of the Residential-1 District shall apply. No
lot shall be reduced below the minimum size for the zoning district in
which it is located. Applicant wishes to reduce the existing sub-standard
parcel is in a village overlay district where width of 75’ to be reduced
to 57’ and from 10, 650 sq. ft. by 2556 sq. ft to 8094 sq. ft.
The parcel described as (ID# 010-1102-05) Lots 7-12,
Block 6, Plat of the Village of Cornucopia in Section 34, Township 51
North, Range 6 West, Town of Bell.
Christine Fiege is seeking a variance
from the terms of Section 13-1-60(a) of the Bayfield County Zoning
Ordinance. Section 13-1-60(a) requires buildings and structures to e set
back a minimum of 5’ from side and rear yard property lines. Applicant
seeks to construct a commercial addition at a zero (0) foot side yard
setback in a village overlay district on property described as (ID#
010-1102-04), Lot 6, Block 6 of the Plat of the Village of Cornucopia, in
Section 34, Township 51 North, Range 6 West, Town of Bell.
The Goldridge Group of Bayfield (follow-up
from the Aug. 23, 2003 public hearing and meeting), as Developer
is seeking an interpretation of 13-1-29(a) & (d) (1) of the Bayfield
County Zoning Ordinance. The Goldridge Group is requesting an
interpretation of this section because they wish to proceed with
construction of three additional condominium buildings, comprising of
seventeen additional condominium unites at the existing Waterford on the
Bay project. Section 13-1-29(a) states it is recognized that carefully
planned large-scale developments may deserve certain exceptions from the
otherwise fixed requirements of the zoning district, where the resulting
development would better serve the objectives of the Chapter than would a
development of the same land without the use of the exception. Such
objectives shall be understood to include the controlling, abatement or
avoidance of erosion and pollution, the protection of natural vegetation,
and the prevention of overcrowding of any natural resources, such as a
lake, and (d) states developments providing shoreline access to navigable
waters shall meet requirements of Section 13-1-32(e).
The legal description of possible expansion property
is a parcel of land located in part of Lot 2 of Bayfield County Certified
Survey Map No. 000876 and Lots 1-4 and parts of Lots 5-7 of the Plat of
Apostle Harbours, and part of Government Lot 3, all in Section 22,
Township 50 North, Range 4 West, Town of Bayfield. (Metes
and Bounds available upon request at the Zoning Office.)
Status Report: Discussion of any
court decisions for cases under review since the last meeting of the
Board. (i.e. NA)

contained in files of the above cases
9:15 a.m. Acceptance of oral or
written testimony from interested parties
Upon exhaustion of public input, notice is served
that the Board of Adjustment pursuant to Section 19.85 (1)(a) Wisconsin
Statutes may convene in closed session to deliberate on one or more of the
above cases. Following any such deliberation, the Board will reconvene in
open session to render and announce their decisions.
